Trump only wants to issue passports to men and women. He has appealed to the Supreme Court

The Trump administration has appealed to the US Supreme Court to overturn a court order preventing the State Department from pursuing a policy of issuing passports labeled only “male” or “female.”

The policy is based on an executive order by President Donald Trump stating that “sex is an immutable biological category.” However, Federal Judge Julia Kobick ruled in April that the measure is discriminatory and violates the constitutional rights of transgender, non-binary, and intersex individuals.

She subsequently blocked the application of the regulation for all passport holders. The 1st Circuit Court of Appeals upheld her ruling, prompting the White House to appeal to the Supreme Court.

The Justice Department argues that citizens have no right to force the government to use inaccurate gender information in official documents.

Lawyers for the American Civil Liberties Union, on the other hand, speak of unjustified discrimination and a threat to fundamental rights, including freedom of travel and the right to live without government harassment.
