German court orders X to share data on Hungarian elections
The Berlin Court of Appeal has ruled that Platform X must provide verified researchers with access to public data related to the Hungarian parliamentary elections to be held on April 12. This mainly concerns data on the reach and engagement of posts.
The decision takes effect immediately and, according to lawyers, cannot be appealed. If Elon Musk's company fails to comply, it faces fines.
The court has also set a precedent in the application of the EU Digital Services Act (DSA), which requires large platforms to make data available for research into risks such as disinformation and election manipulation.
While the lower court originally claimed that the case fell under Irish jurisdiction, the appeals court recognized that German courts can act when it is in the public interest in Germany.
The decision comes at a time of tense campaigning in Hungary, where Viktor Orbán faces strong opposition.
