Charlie Kirk Murder Suspect Still Faces Death Penalty
Tyler Robinson, who is accused of murdering conservative commentator Charlie Kirk, still faces the death penalty. On Friday, Judge Tony Graf Jr. rejected a defense motion to remove the death penalty as a possible sentence, after the defense accused the prosecution of violating a court order prohibiting comments on the case, Fox News reports.
Although the judge found one of the prosecutors guilty of contempt of court for publicly commenting on the strength of the evidence, he ruled that such conduct did not justify removing the possibility of the death penalty. Instead, he ordered an expanded jury pool to ensure a fair trial.
The dispute also centers on ballistic evidence. The defense argued that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) failed to link the fatal bullet to a rifle belonging to Robinson's grandfather.
The prosecution, however, points out that although the analysis of the projectile was inconclusive, the shell casing found matched the weapon and the caliber was the same. Robinson is charged with the murder of Charlie Kirk during the Turning Point USA event in September 2025.
