Attorneys for 23-year-old Tyler Robinson, who is charged with murdering conservative activist Charlie Kirk, are seeking to have the death penalty taken off the table. They argue that the single shot that killed Kirk did not create a “high probability” of death to others. Under Utah law, such a risk is required for prosecutors to seek the death penalty.

Kirk was shot on 10 September 2025 during a public debate at Utah Valley University in Orem.

Prosecutors, however, argue that Robinson knowingly endangered others when he fired a scoped rifle from a position above a crowd of thousands. They say he loaded four rounds in case he missed with the first shot.

Prosecutors cite the risk to bystanders as an aggravating factor justifying the death penalty. A hearing is scheduled for 1 September at which a judge may decide whether there is sufficient evidence for Robinson to stand trial. Robinson has not yet entered a plea.
