Court orders insurance company to pay compensation for stillborn twins
A court in Poland has ruled that Vienna Life insurance company must compensate a mother who gave birth to stillborn twins in the 19th week of pregnancy.
Although the woman had insurance covering this type of event, the insurance company refused to pay, citing its internal definition of a stillborn child as being born after the 22nd week of pregnancy. However, the courts did not accept this interpretation.
The District Court in Szczecin emphasized that the insurance company had not proven that it had clearly informed the client in advance about the exclusions from liability. The Regional Court dismissed its appeal in January 2026 and confirmed the obligation to pay the insurance benefit and reimburse the court costs.
Lawyers from Ordo Iuris say this is a precedent-setting decision that may help other parents in similar situations. According to them, the ruling also confirms that a child has value regardless of the stage of prenatal development.
