Irish Teacher Jailed amid Trans Row Released – for Now

Enoch Burke, whose dispute with his former employer and the Irish state has attracted international attention, has been released from prison after spending more than 700 days behind bars. But his freedom may prove short-lived.

Enoch Burke, the Irish teacher who has spent more than 700 days in prison for contempt of court following a dispute over transgender pronouns at the school where he was formerly employed, has been released from prison. However, he could yet be returned to custody.

Burke's case has become a cause célèbre for conservatives in Ireland and abroad. The dispute began in 2022 when he received a circular from his school informing staff that a student had begun a gender transition from male to female and requesting that teachers use the student's new name and female pronouns. Burke loudly refused, insisting from the beginning that he would not “call a boy a girl”.

Consistent Rejection of the Process

For his part, Burke has consistently rejected the legitimacy of every stage of the process, including his suspension and subsequent dismissal. Despite court rulings, he continued to report to the school each morning and enter the premises. One judge described him as “haunting the school like a ghost”. The school eventually obtained an injunction ordering him to stay away from the campus, but Burke repeatedly ignored it.

It was this refusal to comply with the ruling, rather than his views on transgender pronouns, that led to his imprisonment. The courts repeatedly offered Burke the opportunity to “purge his contempt” by agreeing to obey the injunction. He declined each time, ultimately spending almost two years in prison.

In practice, Burke’s freedom depended on a single undertaking: that he would agree to stay away from the school. He chose prison rather than accept the court’s conditions.

The High Court ordered Burke's release because Irish schools have now begun their annual 10-week summer holiday. With the school closed, the court concluded there was no immediate risk of disruption even if Burke returned to the grounds. Since his previous release Burke has also been formally dismissed from his teaching position, although he does not accept that decision.

The case has become one of the most unusual legal disputes in modern Ireland. Burke's refusal to comply with successive court orders has resulted in more than two years in prison and hundreds of thousands of euros in accumulated fines. The presiding judge estimated the penalties at more than €250,000 ($286,407). Despite those consequences, Burke has remained steadfast in his determination to continue the legal fight.

Released – But Unrepentant

Speaking after his release on Wednesday, Burke again criticized the courts, the disciplinary process, his former school and the Irish state. He maintained that the case stems from his refusal to use transgender pronouns for a student, a characterization that the courts have repeatedly rejected.

The dispute over pronouns undoubtedly triggered the conflict, but the courts have consistently held that his imprisonment resulted from his repeated refusal to comply with court orders requiring him to stay away from the school.

For now, Burke is free. Irish schools will reopen at the end of August, and if he returns to the school in defiance of the injunction, he could once again face imprisonment for contempt of court as well as further financial penalties.

Supporters regard his willingness to endure imprisonment and mounting financial penalties as an example of steadfast commitment to conscience and religious conviction. Critics, by contrast, see it as an act of needless self-destruction and a rejection of the rule of law.

That divide has turned Burke into one of the most polarizing figures in modern Irish public life. As long as he continues to reject the authority of the courts and the legal proceedings against him, his case is likely to remain the subject of debate.
