EU Reviews ChatGPT Under DSA
The European Commission is examining whether OpenAI’s ChatGPT platform falls under the stricter regulatory regime of the Digital Services Act (DSA).
The review follows an increase in the number of users in the European Union beyond the threshold of 45 million monthly users, which is key for classification as a very large online platform. According to OpenAI data, ChatGPT search in the EU has reached an average of more than 120 million monthly active users.
The Commission said it is analysing the available data and noted that the assessment of such services, including large language models, is carried out on a case-by-case basis.
If ChatGPT is classified as a very large platform under the DSA, it would face stricter obligations on transparency, risk management and user protection.
