Then, in April 2025, matters took an even darker turn. As she prepared finally to sit some of the examinations she had missed, a sexually explicit image – supposedly of the student herself, taken in the moments after her rape – was anonymously circulated to more than 170 members of the university community, including students and academic staff.

An Irresistibly Dramatic Story for Journalists

The story quickly became irresistible to the Irish media and a national cause célèbre.

Politicians, commentators and campaigners lined up to denounce yet another example of institutional misogyny and the mistreatment of women who report sexual violence. Among the most prominent voices was Ruth Coppinger, one of Ireland’s best-known feminist and socialist politicians, who used the Dáil to condemn what she said was the sexism and misogyny revealed by the case.

The student herself was never publicly identified. Yet, referred to under a pseudonym and granted anonymity to share her tale, she appeared – in shadow or with her voice altered – across many of Ireland’s largest media outlets. The interviews varied in detail, but the message was consistent: here was a young woman who had survived an alleged rape only to be failed, repeatedly and callously, by one of Ireland’s leading universities. She herself was presented as another example of a brave young woman challenging an unjust and cruel system. The university, by contrast, was presented as institutionally unsympathetic.

There was only one difficulty with that narrative: it was largely nonsense.

The Court Judgment Reporters Missed – or Did Not Want to See

Long before much of the coverage appeared, the Irish High Court had published a lengthy and detailed judgment dealing with the student’s dispute with UCD. It was a public document, readily available to any journalist who took the trouble to read it.

And while it did not determine whether the alleged rape had occurred, it painted a substantially more complicated picture of the academic dispute than the one presented to the public.

One thing the judgment revealed, for example, was a much more troubled academic history than most of the subsequent coverage suggested.

The student alleged that she had been assaulted by another student in late February 2023, and there is no question that the events she described, if true, would have had grave consequences for her studies and personal wellbeing.

But her academic difficulties had not begun with the alleged assault.

The warning signs had appeared much earlier. In November 2021, during her first year, she had approached the university about taking an immediate leave of absence. By the autumn of 2022, her attendance had been badly affected by what she described as a combination of family responsibilities, financial pressures and the demands of working two full-time jobs alongside her degree.

In December 2022 – two months before the alleged assault – she failed three core modules. By her own subsequent account, she had missed most of her classes during the preceding term, was “constantly struggling” with her education and had experienced a serious deterioration in her emotional wellbeing.

By early February 2023, the university had placed her on an academic plan, assigned her a mentor and begun discussing how she might remediate the examinations she had already failed.

This does not, of course, make the sexual crime she alleged was committed against her any less serious. It does, however, materially alter the academic story. The alleged assault did not transform an otherwise unblemished student into one who suddenly fell behind.

That was a detail of obvious significance. Yet it was almost entirely absent from the account presented to the Irish public.

A University Unfairly Maligned

Similarly, the subsequent dispute was more complicated than a simple refusal by UCD to accommodate a traumatized student. In actual fact, the university ultimately awarded her so-called “special grades” in six modules on exceptional-circumstances grounds on foot of the alleged rape. The central argument then became whether she could graduate and become a doctor without completing many of the other modules that she had missed.

The High Court, arbitrating the dispute, found firmly in the university’s favor.

Ms Justice Marguerite Bolger described the student’s expectation that she should simply be permitted to progress as “unrealistic and devoid of any legal basis”. She found that UCD’s approach to remediation was lawful, proper and proportionate. She also rejected the explanations offered for the student’s failure to sit later examinations, describing them at various points as unconvincing, groundless in fact and unacceptable.

The university, in other words, had not simply forced a rape victim to carry on as if nothing had happened. It had granted exceptional academic accommodations, offered repeated opportunities to sit outstanding examinations and attempted to construct a plan through which the student might eventually complete her studies.

The chronology became stranger still in April 2025.

By then, UCD had afforded the student another opportunity to sit the six examinations she still needed to remediate in May. On 22 April – only weeks before those examinations – a sexually explicit image was anonymously sent to more than 170 university email accounts and circulated more widely among students.

The student said the image depicted her in the aftermath of the alleged assault.

A Startling Series of Coincidental Calamities

To be clear on the timeline: the rape had allegedly happened two years earlier, just before the student was due to sit exams. And now, two years later, just before she was due to take them again, explicit images of her were circulated.

Taken individually, each event might readily be understood as a terrible misfortune. Taken together, they formed an extraordinary sequence. At almost every point when the student was expected to address her outstanding academic obligations, some new trauma, dispute or calamity intervened.

There was another feature of the case that, while proving nothing on its own, was nevertheless striking. According to both the High Court judgment and the student’s own public account, she did not report the alleged rape to An Garda Síochána. Nor did she herself initially report the subsequent image-based abuse to the Gardaí.

Instead, both matters were raised only with the university authorities.

The Irish Police Finally Get Involved

In relation to the alleged rape, there was necessarily a limit to what the university itself could do. It could offer welfare and academic support, but it was not a criminal investigating authority and could not determine whether a criminal offense had occurred.

The circulation of the intimate image was different, however. Here was an image that had been anonymously distributed to more than 170 members of the university community, including academic staff and students. Faced with what appeared to be a serious criminal offense, UCD referred the matter to An Garda Síochána, triggering a forensic investigation into the origin of emails sent from a ProtonMail account.

An Extraordinary Turn

It is at this point that the story takes an extraordinary turn.

This week, immediately after the hearing of her appeal against the High Court judgment, the student was arrested by Gardaí investigating alleged deception against University College Dublin.

She was subsequently released without charge, and a file is now being prepared for the Director of Public Prosecutions. She remains entitled to the full presumption of innocence, and no conclusion can properly be drawn about the ultimate outcome of the investigation.

However, Irish media reports say that the arrest followed the emergence of alleged serious discrepancies between information supplied to the university and evidence subsequently obtained by Gardaí.

Those reports refer to alleged inconsistencies in the chronology of events and to apparent contradictions between documentation furnished to the university concerning certain medical treatments and what investigators now believe to have been the student’s whereabouts.

If those reports are accurate, they represent a remarkable development.

For more than a year, the principal criminal investigation arising from this affair was the Garda inquiry initiated after UCD reported the anonymous circulation of the intimate image. Yet the only person publicly known to have been arrested as part of that investigation is the student herself.

That fact alone, of course, proves nothing. The investigation remains ongoing, no charge has been brought, and the student may ultimately be entirely exonerated.

But it is undeniably a dramatic reversal in a case that, until now, had been presented to the public almost entirely from one perspective.

An Enormous Journalistic Failure

The most remarkable aspect of this case, however, is not the Garda investigation. It is the conduct of much of the Irish media.

Most of the essential facts outlined above were not hidden.

Long before the story dominated headlines, the High Court had delivered a detailed judgment setting out the student’s academic history, the university’s account of events and the court’s reasons for rejecting her legal challenge.

It was a public document, available to every newsroom in the country.

Indeed, writing for Gript in March, this writer drew attention to the existence of that judgment and to the striking divergence between its contents and the narrative then dominating much of the national media.

That divergence scarcely slowed the coverage.

Instead, many outlets launched themselves into a veritable frenzy of self-righteousness and public self-recrimination. UCD was widely pilloried. Significant student protests followed. Politicians cited the case as emblematic of Ireland’s failure to protect women from sexual violence.

Chat shows, talk-radio programs and drive-time broadcasts repeatedly returned to the story as yet another example of an uncaring institution failing a vulnerable young woman.

Perhaps elements of that narrative will ultimately prove to have been justified. The Garda investigation has not concluded, and further evidence may yet emerge.

But that is not really the point.

The point is that journalism is supposed to proceed from evidence rather than assumption.

Faced with a detailed High Court judgment that plainly complicated the prevailing narrative, far too many journalists appear either not to have read it or to have decided that its contents were inconvenient.

Neither possibility reflects well on a profession that rightly expects others to respect due process, careful fact-finding and fairness.

It is human and natural for everybody, including journalists, to make mistakes. Every reporter will, at some point in his or her career, misunderstand a document, place too much trust in a source or become so captivated by the apparent moral clarity of a story that inconvenient facts receive less attention than they deserve.

What is remarkable, however, is the consistency with which these mistakes appear to occur in only one direction.

Tragedy Layered Upon Tragedy

At the heart of the UCD story sits an undoubtedly troubled young woman who has encountered serious difficulties in completing her academic studies.

What is already clear, however, is that much of the story presented to the Irish public in March was materially incomplete and devoid of essential context and easily established facts.

Journalists had before them a detailed judgment that plainly complicated the story they were telling. Too many either ignored it or gave it remarkably little weight. That is a failure of journalism regardless of what happens next.

At the center of the affair is a young woman whose life and studies appear to have descended into a prolonged crisis. Around her sits a university that was publicly condemned despite a court finding that its academic decisions were lawful and proportionate. And surrounding both is a media culture that once again appears to have preferred emotional resonance to evidential restraint.

That, like so much else in this tale, is tragedy layered upon tragedy.
